InfoCision Management Corporation (“InfoCision,” “we,” “us,” “our”) respects your privacy. This Privacy Policy (“Privacy Policy” or “Policy”) describes how we collect, use, and disclose your personal information and any rights you may have with respect to such information. It governs personal information we collect through our websites (“Sites”) and personal information we collect through any other means to provide our services or perform other business activities (collectively, “Services”).

The Policy does not apply to (1) personal information we process solely as a service provider on behalf of our clients or (2) personal information we process in an employment context, such as information collected from or about job applicants or employees.

Please read this Privacy Policy before using our Sites or Services. By accessing or using our Sites or Services, you agree to this Policy. California residents should also read our California Privacy Notice, which supplements this Policy.

1. About This Privacy Policy

Privacy policy changes

This Privacy Policy is subject to change. We encourage you to review it frequently for amendments. When we make material changes to the Policy, we will take reasonable steps to notify individuals such as sending email notifications or posting notice on our website. Privacy Policy changes are effective immediately and you accept these changes by continuing to use the Sites or Services. If we determine that a change to this Policy will result in the use of previously-acquired personal information in a materially new way, we will provide you notice of such change and take any additional actions required by applicable law.

Conflict between this policy and laws and regulations

When federal, state, or local laws or regulations require a higher level of protection for your personal information, they take precedence over this Privacy Policy.

2. Information We Collect

We may collect information that personally identifies, relates to, describes, or is capable of being associated with you (“personal information”). The types of personal information we collect about you varies based on how you use the Sites and/or Services and your relationship with us.

Personal information we collect in a business-to-business context

We may collect the following categories of personal information in the business-to-business context:

• Identifiers such as name, work address, email address, phone number;
• Internet or other electronic network activity information such as IP address, device specifications, browsing and search history, clicks, information about how you interact with our emails and digital advertisements, and other data collected by cookies and similar technologies;
• Geolocation data such as non-precise geographic location indicators from mobile devices and websites;
• Audio, electronic, visual, or similar information such as call recordings, email conversations;
• Professional or employment information such as employer, title.

Personal information we collect in other contexts

We may collect the following categories of personal information in other contexts:

• Identifiers such as name, address, email address, phone number, record identifier, date of birth;
• Characteristics of protected classifications under applicable law such as age, marital status, gender, military or veteran status, ethnicity, religion;
• Other demographic information such as the number and approximate ages of children, what language(s) you speak, the number of persons living at the property, pet ownership status, political affiliation, household and expendable income;
• Commercial information such as records of products and services purchased or charitable contributions, property information, home ownership or purchase records, credit card ownership status;
• Internet or other electronic network activity information such as IP address, device specifications, browsing and search history, clicks, information about how you interact with our emails and digital advertisements, and other data collected by cookies and similar technologies;
• Geolocation data such as non-precise geographic location indicators from mobile devices and websites;
• Medical or health information assigned at a household level based on survey responses provided to third parties;
• Professional or employment information such as employer, title, occupation;
• Education information such as education level; and
• Inferences drawn from other personal information that relate to your preferences, interests, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes (e.g., consumer interest, propensity to purchase, and wealth models).

Some of the personal information listed above, including ethnicity, religion, and medical or health information, may be considered sensitive personal information under applicable privacy laws. We do not collect sensitive personal information when applicable law requires consent or provides opt-out rights. 

Deidentified and aggregate information

We may deidentify or aggregate personal information such that we can no longer reasonably associate it with an identifiable person. We may use and disclose deidentified and aggregate data for any business purpose permitted by applicable law. 

Usage data and sites activity

We automatically collect information in connection with the actions you take on our Sites. We refer to this type of information as “usage data.” Usage data may include information about your device, browser, operating system, internet service provider, and IP address. It may also include information about your interactions with the Sites, such as the pages you view, the page and search terms used to reach our Site, the date, time, and duration of your visit, and your clicks. If we can reasonably associate this data with you, we treat it as personal information under the categories of Identifiers or Internet or other electronic network information, as appropriate. If we cannot reasonably associate this information with you, we treat it as anonymous usage data.

Communication recordings

We may record calls and retain the content of text messages, chat transcripts, emails, and other written or electronic communications between you and us. By communicating with us, you consent to our recording and retention of communications.

3. How We Collect Information

From you

We may ask you to provide personal information when you communicate with us online or offline. You are not required to provide personal information; however, certain features of the Sites or Services may be unavailable unless you provide the requested information. We may also capture contact information, such as phone number and email address, when you contact us.

Third-party data sources

Where permissible, we may collect personal information from third-party data sources such as data brokers, trade associations, marketing agencies and partners, analytics firms, and government agencies.

Cookies and other automated tools

We and third parties may use cookies and other automated data collection tools (collectively “cookies”) to collect personal information and usage data, track your interaction with our Sites and Services, improve the experience of the Sites and Services, and conduct cross-context behavioral or targeted advertising (collectively “targeted advertising”).

We may use the following types of cookies:

• Strictly Necessary: These cookies are essential to operate the Sites and provide you with services you have requested.
• Advertising Cookies: These cookies allow us and third parties to learn more about you, including your use of our Sites and other websites, and advertise products or services that might interest you.
• Analytics Cookies: These cookies help us and third parties understand how our Sites are working and who is visiting our Sites.

You can opt-in or opt-out of certain types of cookies by managing your “Cookies Preferences.”

If you want to reduce the overall volume of targeted advertising you receive, you can also visit the Digital Advertising Alliance (DAA) Consumer Choice Page and/or the Network Advertising Initiative Consumer Opt-Out Page. These websites allow you to opt-out of targeted advertising from member networks. 

4. How We Use and Disclose Information

Personal information collected in a business-to-business context

We may use personal information collected in a business-to-business context for general business purposes, such as:

• To provide the Sites and Services;
• Marketing and analytics: to send communications and offers for our or third parties’ products or services, and perform analytics;
• Collections: to collect on outstanding balances;
• Other company communications: to otherwise communicate with you;
• Website use and analytics: to provide you with access to and use of our Sites and Services, analyze individuals’ use of our websites, including the use of third-party web analytics services;
• Product research: to conduct research and analysis for maintaining, protecting, and developing services;
• Business operations: to evaluate, develop, and improve business operations, products and services offered, perform business administration and other normal business activities;
• Compliance: to comply with applicable legal requirements, industry standards, contractual obligations, our policies, and take actions that we deem necessary to preserve and enforce our rights and the rights of others;
• Information security and fraud prevention: to operate information security and anti-fraud programs; and
• Other purposes: as otherwise described to you at the point of collection, with your consent, or as otherwise required by applicable laws.

Consumer information

We may use personal information collected about consumers for the following purposes:

• Client services: to provide marketing, recruitment, customer service, or other services to our clients;
• Profiling: to create inferences that relate to your preferences, interests, characteristics, predispositions, behavior, and attitudes (e.g., consumer interest and propensity to purchase or donate models);
• Business operations: to evaluate, develop, and improve business operations, products and services offered, perform business administration and other normal business activities;
• Compliance: to comply with applicable legal requirements, industry standards, contractual obligations, our policies, and take actions that we deem necessary to preserve and enforce our rights and the rights of others; and
• Other purposes: as otherwise described to you at the point of collection, with your consent, or as otherwise required by applicable laws.

Reviews and testimonials

If you provide a review or testimonial, we may post it publicly on our Sites or in other advertising materials. By providing a review or testimonial, you give us permission to use it in any manner and for any purpose, including in marketing and advertising communications.

Service providers

We may disclose personal information to other businesses to provide services to us or to assist us in providing our Sites and Services. For example, we may disclose personal information to fulfillment and account servicing vendors, payment processors, customer service providers, marketing and communications vendors, delivery services, data analytics vendors, research and development vendors, IT and network administration vendors, professional service firms, other administrative services providers. In the past 12 months, we may have disclosed each category of personal information to each category of service provider.

Service providers must use reasonable security measures to protect your personal information and cannot use the personal information we provide other than to provide services to us.

Third-party selling and sharing

We may disclose personal information to advertising, social media, and analytics companies in ways that qualify as a “sale” or “sharing” (for targeted advertising purposes) under applicable privacy laws. In the past 12 months, we sold or shared personal information to Google.

Other third-party disclosures

We may occasionally disclose your personal information to third parties for purposes that do not constitute a sale or sharing (for targeted advertising purposes). For example:

• To comply with the law;
• To respond to legal requests (including court orders, investigative demands, and subpoenas) if, in our discretion, we believe it is necessary or appropriate;
• To prevent or stop any illegal, unethical, or legally actionable activity;
• To protect the safety, property, or rights of ourselves, consumers, or any other third party;
• In connection with a proposed or actual corporate transaction such as a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets (whether by private sale, through operation of law, as part of a divestiture plan, or otherwise), or similar corporate transaction;
• To businesses controlling, controlled by, or under common control with us; and
• For additional purposes with your consent or at your direction.

5. Third-Party Websites and Links

The Sites or Services may contain links to third-party websites, including social media platforms. Please be aware that if you access these links, you will leave our site. We encourage users to read the privacy policies of those sites, as we are not responsible for their content, links, or privacy practices.

6. Data Security

We recognize the importance of safeguarding the confidentiality of personal information from loss, misuse, or alteration. Accordingly, we employ commercially reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, disclosure, and use. Even with these safeguards, no data transmission over the Internet or other network can be guaranteed to be secure. As a result, while we strive to protect information transmitted on or through our Sites or Services, you do so at your own risk.

7. Data Retention

We retain each category of personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including providing services, managing client relationships (including where we act as a service provider or processor on behalf of a client), complying with legal and regulatory requirements, resolving disputes, enforcing our agreements, and supporting legitimate business needs consistent with applicable law. Retention periods vary depending on the type of information, the nature of the relationship, and applicable legal or contractual obligations. When personal information is no longer required for these purposes, we securely delete or de-identify it in accordance with our data retention policies and applicable law. We refresh personal information previously obtained from data brokers at regular intervals (monthly, quarterly, etc.).

8. Children and Minors’ Privacy

The Sites and Services are not intended for individuals under the age of 18 (“minors”) and we do not knowingly collect, sell, share, or disclose personal information from minors. If we become aware that we have inadvertently received personal information from a minor, we will delete such information from our records.

9. Additional State Privacy Rights

If you are a consumer who resides in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have additional rights to access and control your personal information. Subject to applicable exemptions, privacy rights include:

• Right to Opt-Out from the Sale or Sharing of Personal Information. You may direct us not to sell or share (for targeted advertising purposes) your personal information to third parties.
• Right to Know and Access. You may request what personal information we collected about you (including the categories or specific pieces of personal information), the categories of sources from which we collected your information, the business or commercial purpose(s) for collecting it, and the categories and names of third parties to whom we sold or disclosed personal information. We will provide a copy of the specific personal information we maintain about you in a portable and, if technically feasible, readily-usable format.
• Right to Delete. You may request that we delete information we collected about you.
• Right to Correct. You may request that we correct inaccurate personal information we maintain about you. If you only wish to update your contact information or other personal information rather than disputing its accuracy, please make the changes directly in your account or contact us using the information below.
• Right to Appeal. You may appeal our decision with respect to a previously-submitted privacy request.

Submitting a privacy request

You can opt-in or opt-out of third-party data collections from our Sites that qualify as sales or relate to targeted advertising by setting your Cookie Preferences. You may also opt-out by using your browser or a browser extension to send us a Global Privacy Control  (GPC) signal.

If you are a resident of a state that provides privacy rights and would like to exercise other privacy rights, you may submit a request by calling us at 1-888-803-8563 or submitting your request through our online privacy request form. After you submit your request, we may contact you to obtain additional information necessary to locate your record and/or verify your identity. For example, we may require you to verify certain information in our files or submit a signed declaration under penalty of perjury verifying your identity. We cannot process certain requests without verifying your identity, so please respond promptly to our request.

Authorized agent

If you are an authorized agent submitting certain types of privacy requests for another consumer, you must provide a copy of a lawful power of attorney or written signed authorization from the consumer. After submitting the request, you will receive an email. You can respond to this email to provide the required documentation. Depending on the type of request, we may contact you and/or the consumer on whose behalf you claim to act to verify your authorization or the consumer’s identity.

Non-discrimination notice

We will not discriminate against any consumer for exercising their privacy rights under law or this Policy.

California “Do Not Track” Disclosure

Do Not Track is a web browser privacy preference that causes the web browser to broadcast a signal to websites requesting that a user’s activity not be tracked. At this time, our Site and Services do not respond to “do not track” signals. The Sites do, however, recognize GPC signals as noted above. 

California “Shine the Light” Law

California Civil Code Section 1798.83, known as the “Shine The Light” law, allows California residents to opt-out of having their personal information shared with third parties for direct marketing purposes. To exercise your rights under this law, please submit a request to opt-out of sales and sharing using the methods described above.
