This California Privacy Notice (the “Privacy Notice” or “Notice”) provides limited information to California residents only about how InfoCision Management Corporation and its affiliates (“InfoCision,” “we,” “us,” “our”) collect, use, and disclose personal information. For more details about our privacy practices and any privacy rights you may have, please see our Privacy Policy. Neither this Notice nor the Privacy Policy apply to (1) personal information we process solely as a service provider on behalf of our clients or (2) personal information we process in an employment context, such as information collected from or about job applicants or employees.
Personal information we collect in a business-to-business context
We may collect information that personally identifies, relates to, describes, or is capable of being associated with you (“personal information”). The types of personal information we collect about you will vary based on how you use the Sites and/or Services (as defined in the Privacy Policy) and your relationship with us, but may include:
- Identifiers such as name, work address, email address, phone number;
- Internet or other electronic network activity information such as IP address, device specifications, browsing and search history, clicks, information about how you interact with our emails and digital advertisements, and other data collected by cookies and similar technologies;
- Geolocation data such as non-precise geographic location indicators from mobile devices and websites;
- Audio, electronic, visual, or similar information such as call recordings, email conversations; and
- Professional or employment information such as employer, title.
Personal information we collect in other contexts
We may collect the following categories of personal information in other contexts:
- Identifiers such as name, address, email address, phone number, record identifier, date of birth;
- Characteristics of protected classifications under applicable law such as age, marital status, gender, military or veteran status;
- Other demographic information such as the number and approximate ages of children, what language(s) you speak, the number of persons living at the property, pet ownership status, political affiliation, household and expendable income;
- Commercial information such as records of products and services purchased or charitable contributions, property information, home ownership or purchase records, credit card ownership status;
- Internet or other electronic network activity information such as IP address, device specifications, browsing and search history, clicks, information about how you interact with our emails and digital advertisements, and other data collected by cookies and similar technologies;
- Geolocation data such as non-precise geographic location indicators from mobile devices and websites;
- Professional or employment information such as employer, title, occupation;
- Education information such as education level; and
- Inferences drawn from other personal information that relate to your preferences, interests, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes (e.g., consumer interest, propensity to purchase, and wealth models).
Some of the personal information listed above may also be considered “personal information” as defined in Cal. Civ. Code § 1798.80(e).
How we use personal information collected in a business-to-business context
We may use personal information collected in a business-to-business context for general business purposes, such as:
- To provide the Sites and Services;
- Marketing and analytics: to send communications and offers for our or third parties’ products or services, and perform analytics;
- Collections: to collect on outstanding balances;
- Other company communications: to otherwise communicate with you;
- Website use and analytics: to provide you with access to and use of our Sites and Services, analyze individuals’ use of our websites, including the use of third-party web analytics services;
- Product research: to conduct research and analysis for maintaining, protecting, and developing services;
- Business operations: to evaluate, develop, and improve business operations, products and services offered, perform business administration and other normal business activities;
- Compliance: to comply with applicable legal requirements, industry standards, contractual obligations, our policies, and take actions that we deem necessary to preserve and enforce our rights and the rights of others;
- Information security and fraud prevention: to operate information security and anti-fraud programs; and
- Other purposes: as otherwise described to you at the point of collection, with your consent, or as otherwise required by applicable laws.
How we use personal information collected about consumers
We may use personal information collected about consumers for the following purposes:
- Client services: to provide marketing, recruitment, customer service, or other services to our clients;
- Profiling: to create inferences that relate to your preferences, interests, characteristics, predispositions, behavior, and attitudes (e.g., consumer interest and propensity to purchase or donate models);
- Business operations: to evaluate, develop, and improve business operations, products and services offered, perform business administration and other normal business activities;
- Compliance: to comply with applicable legal requirements, industry standards, contractual obligations, our policies, and take actions that we deem necessary to preserve and enforce our rights and the rights of others; and
- Other purposes: as otherwise described to you at the point of collection, with your consent, or as otherwise required by applicable laws.
Third-party selling and sharing
We may disclose personal information to third parties in ways that qualify as a “sale” or “sharing” (for targeted advertising purposes) under California law. In the past 12 months, we sold or shared personal information to advertising, social media, and analytics companies.
How long we retain your personal information
We retain each category of personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including providing services, managing client relationships (including where we act as a service provider or processor on behalf of a client), complying with legal and regulatory requirements, resolving disputes, enforcing our agreements, and supporting legitimate business needs consistent with applicable law. Retention periods vary depending on the type of information, the nature of the relationship, and applicable legal or contractual obligations. When personal information is no longer required for these purposes, we securely delete or de-identify it in accordance with our data retention policies and applicable law. We refresh personal information previously obtained from data brokers at regular intervals (monthly, quarterly, etc.).
